January 5 (some sources say Jan 4), 1976 -
Malcolm "Mal" Evans (27 May 1935 - 5 January 1976) is best known as the road manager, assistant and friend of the Beatles.
At his Los Angeles motel apartment at 8122 West 4th Street, Mal Evans, long time friend and former roadie/bodyguard of the Beatles, is shot to death by police lieutenant Charles Higbie (of the LAPD robbery and homocide division). In a drunken stupor, Mal had become uncontrollably violent, appeared to be attempting suicide, and pointed a rifle at the officer, who, in self-defense, then shot him six times, four bullets hitting Mal.
His new girlfriend, Fran Hughes, with whom he was living, had found him upset and despondent, and when friends couldn't get Evans to release the unloaded rifle he was holding, they called police. Mal had recently separated from his wife, Lili Evans, who had reportedly asked him for a divorce just before Christmas. Mal was working on a book about his time with The Beatles, entitled Living with The Beatles Legend, which was scheduled to be delivered to the publisher, Grosset & Dunlap, on January 12. He was 40 years old. When John was told of Mal’s death, he broke down in tears.

Poor Mal was shot and killed by police on 5 January 1976 in his rented duplex in Los Angeles, because police officers mistakenly believed that the air gun Evans was holding was a rifle. Evans was cremated on 7 January 1976 in Los Angeles, and his ashes were sent by post back to England but were misplaced and lost in the postal system.

According to Source: Beatlelinks Fab Forum, Mal was shot and killed on January 4.
Their entry states:
"Mal Evans dies in Los Angeles, in an unfortunate incident. In a drunken stupor, he had become uncontrollably violent. The recent divorce procedings of his marriage may have contributed to his mental state. The Los Angeles Police shoots him in self defense."
The disparity between the two accounts (IMO) may be due to the eight-hour time difference between England and California, and because the incident may have happened overnight.
A wonderful article about the gentle giant Mal is archived on the UK Times Online website
